Introduction

This website is owned and operated by Ardyssa Beauty. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors beauty services. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

“I” / “We” / “Us” are: Ardyssa Beautyor any representative therefore of.

“You” are: Anyone who uses Our Website.

 

Who can use our website?

In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Terms offered

When buying an item/service, you agree that: (i) you are responsible for reading the full item/service listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item/service when you commit to buy an item and you complete the check-out payment process.

The prices we charge for our products and services are listed on the website. We reserve the right to change our prices for products and services displayed at any time, and to correct pricing errors that may inadvertently occur.

 

Delivery of items purchased through our Gift Shop

Except for Digital Gift Cards, all items will be posted via Royal Mail's  tracked second class service. Items will be posted according to the delivery schedule below:

Digital Vouchers

  • Your E-voucher is sent to your requested email upon payment

Printed Vouchers, Experiences, Products and Gift Bags

  • Orders will be fulfilled within 2 working days of receipt of payment and send by Royal Mail, second class.

 

Although Royal Mail aim to deliver second class items within 48 hours, this is not guaranteed and may be affected by a number of outside influences such as breakdowns, inclement weather, road and rail closures and any other force majeure. Ardyssa Beauty accept no liability where this may be the case.

Return and refund policy - Gift Shop Purchases

We hope that you will be happy with any purchase you make from Ardyssa Beauty.  However we understand that at times items may not be as expected and should you wish to return an item, you may do so within the timescales and conditions outlined below.

 

You have a right to change your mind regarding a purchase made from our gift shop within 14 days of receipt of the item.

 

You forfeit this right in respect of products sealed for health protection or hygiene purposes, once the seals have been broken or any products which become mixed inseparably with other items after their delivery. We require the product/s returned to be in a new condition should a refund be required.

You have a right to return a faulty product within 30 days of receipt of the item, unless the fault is due to

  • Fair Wear & Tear

  • Wilful Damage

  • Accidental Damage

  • Negligence by the Customer or any third party.

  • Usage otherwise than as recommended by the Manufacturer

  • Failure to follow the Manufacturer’s instructions

  • Any alteration or repair carried out without the Manufacturers approval

When you return a product, we will process your refund as quickly as possible and do our utmost to ensure this is within seven working days of when we receive and verify the item.  When you return a product that you purchased using a credit/debit card, the same card you used will be credited with the refund.

Should you wish to return an item, please ensure your return is authorised by our customer services team by emailling info@ardyssabeauty.co.uk, including the reason for return and required action. After the return has been agreed, a returns reference will be provided and you will be advised on how to return the item to us.  All shipping and returns information will be supplied by our Customer Services Team.   Any returns that are sent to Ardyssa Beauty without the knowledge or authorisation of the Customer Services Team may be rejected.

 

We will pay the costs of return if the products are faulty or not as described or if you are ending the contract because we have told you of an upcoming change to the product or these terms, an error in pricing or description, or because you have a legal right to do so as a result of something we have done wrong.

 

In all other circumstances you must pay the costs of return.

When customers are returning goods to Ardyssa Beauty, liability of the package will remain with the customer up until the point of inspection, this is after delivery, we suggest all goods sent to Ardyssa Beauty are sent using a tracked and insured form of postage; Any loss physical/financial will not be covered by Ardyssa Beauty. Items damaged in transit on route to Ardyssa Beauty will be the customer’s responsibility and all claim requirements will be upon the Sender/Customer.

 

Return and refund policy - Services

Ardyssa  Beauty will offer refunds for services under very limited circumstances, as when paying for a service you are paying for product used and time spent in delivering the service to you.

Where you are dissatisfied with the results of your service, Ardyssa Beauty will look to provide a repair service as soon as is practicable. 

​

Issues that are experienced within 48 hours will be reviewed and most often a fix or repair will be offered free of charge. This assumes that all proper aftercare advice has been followed and that photos of the area(s) affected are provided to allow an assessment of the extent of repair required. 

 

Issues experienced outside of 48 hours are more likely to be due to external factors, however they should be notified and discussed to determine the best course of action to repair. Costs for repair will be incurred, as detailed in our service listings and a call out charge may be incurred of £15.00.  Photo's must be supplied at the time of contacting us in order that we can assess the extent of the repair required.

Cancellation and Lateness

We will only accept bookings through Fresha for Nail (including manicure, pedicure and nail enhancements), Lash and Brow Appointments, our online booking system provider. Fresha will ask for a deposit at time of booking. Please note that your appointment is not secured until the deposit is paid. The outstanding balance of your treatments will be charged at the end of your appointment. You can pay by card via the Fresha App or by Cash.

Aesthetics Services will be booked and paid for via the Insync application, powered by Faces Consent. Deposits will be applicable to secure your booking, to cover prescription costs and cost of products. 

​

Deposits are non-refundable.

​

If for any reason Ardyssa Beauty need to cancel an appointment, we will offer an alternative appointment slot at the earliest possible opportunity. The value of your deposit will be transferred to your new appointment.

​

You may reschedule your appointment more than 48 hours prior to your allotted appointment time without charge. The value of your deposit will be transferred to your amended booking. 

​

Should you reschedule within 48 hours of your appointment your deposit will not be transferred to any future booking. You will need to make a new appointment and a new deposit amount will apply.

​

If you cancel your appointment within 24 hours or do not attend your appointment without prior notice, you will be charged for the full amount of the treatments booked.

​

In instances where you are late to your appointment, your treatment time will be reduced accordingly and in extreme circumstances may result in your appointment being cancelled, incurring a charge for the full amount of the treatments booked..

​

Where Ardyssa  have issued an invoice for the remainder of the appointment value, you will not be able to make any further bookings until such time that this is paid in full.

Complaints Policy

There may be times where Ardyssa Beauty does not meet your expectations. In these circumstances we encourage you to let us know. We are committed to learning from your experiences as this will help us to continually improve the services we deliver.

In the event of complaint, please contact info@ardyssabeauty.co.uk and include the following information.

  • Name and contact details

  • The nature of the complaint

  • Details of any steps you have taken to resolve the complaint

  • Details of conversations you have had with us that may be relevant to your complaint

  • Copies of any documents which may be relevant

We will take note of what information you provide to us and will discuss your concerns with you accordingly. We are committed to resolving your complaint within a timely manner.

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Disclaimers and limitation of liability

The law differs from one country to another. This paragraph applies so far as the applicable law allows.

All implied conditions, warranties and terms are excluded from this agreement. If in any jurisdiction an implied condition, warrant or term cannot be excluded, then this sub paragraph shall be deemed to be reduced in effect, only to the extent necessary to release that specific condition, warranty or term.

You are advised that Content may include technical inaccuracies or typographical errors. This is inevitable in any large website. We would be grateful if you bring to our immediate attention, any that you find.

Our Website may contain links to other internet websites. We have neither power nor control over any such website. You acknowledge and agree that we shall not be liable in any way for the Content of any such linked website, nor for any loss or damage arising from your use of any such website or from your buying services or goods via such a website.

The Ardyssa Beauty  Website and  our Services are provided “as is”. We make no representation or warranty that Our Website will be:

  • useful to you;

  • of satisfactory quality;

  • fit for a particular purpose;

  • available or accessible, without interruption, or without error.

 

We claim no expert knowledge in any subject. We disclaim any obligation or liability to you arising directly or indirectly from information you take from Our Website.

We accept no responsibility for third party advertisements which are posted on Our Website or through the Services;

 

We shall not be liable to you for any loss or expense which is:

This paragraph (and any other paragraph which excludes or restricts our liability) applies to our directors, officers, employees, subcontractors, agents and affiliated companies (who may enforce this clause under the Contracts (Rights of Third Parties) Act 1999 / Contracts (Rights of Third Parties) (Scotland) Act 2017 as well as to ourselves.
 

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Ardyssa Beauty. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

Right to suspend or cancel service

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.

Indemnification

You agree to indemnify and hold Ardyssa Beauty harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Ardyssa Beauty be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Ardyssa Beauty assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of England without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in England. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
